The Committee on Ordinances, Legal Matters and Inter-Government Relations chaired by 2nd District Board Member June Mondejar recommended to the 13th Sangguniang Panlalawigan of Iloilo to adopt his committee report and approve the resolution opposing the creation of Boracay Island Development Authority and strongly supporting Resolution No. 2021-1425 of the Sangguniang Panlalawigan of Aklan.
The resolution entitled, "A Resolution Vehemently Opposing the Creation of Boracay Island Development Authority (BIDA) and Strongly Supporting Resolution No. 2021-1425 of the Sangguniang Panlalawigan of Aklan" was agreed and approved by the 13th Iloilo SP.
The Resolution No. 2021-1425 of the Sangguniang Panlalawigan of Aklan entitled, "A Resolution Reiterating in the Strongest Possible Terms the Continuing Objection of the People of Aklan to House Bill No. 9826 Creating a Boracay Island Development Authority (BIDA) in Contravention of the 1987 Philippine Constitution and the Local Government Code of 1991 and Earnestly Imploring and Appealing to the August Senators of the Republic of the Philippines for Their Utmost Understanding of, and to Give Due Consideration to, the Sentiments and Plight of the Aklanons, the Local Government Units of Malay, Aklan, and the Province of Aklan."
A letter for reference and asking for support, was sent by Atty. Reynaldo M. Quimpo, Provincial Vice Governor, 18th SP, Province of Aklan to the Honorable members of 13th Iloilo SP through the Hon. Christine S. Garin, Vice Governor, Province of Iloilo, dated October 15, 2021.
The Sangguniang Panlalawigan of Aklan has been objecting to the creation of the Boracay Island Development Authority (BIDA) under House Bill 9826, entitled "An Act Creating the Boracay Island Development Authority, Defining its Powers and Functions, and Providing Funds Therefor" which was passed on third reading on September 9, 2021.
The Aklan SP has already sent resolutions and position paper to the Office of the President, Senate of the Philippines and Speaker of the House of Representatives.
The 'vehement and sustained opposition' of the Provincial Government of Aklan is grounded on the catastrophic impact on the socio-economic well-being of hundreds of thousands of Aklanons, it is a direct contravention of the Philippine Constitution and the Local Government Code on local autonomy, it is contrary to the primary goal of Boracay Island rehabilitation, and it should not strip the Municipality of Malay of the power to issue business licenses and building permits and it should not restrict the taxation authority of the said municipality to the collection of real estate taxes only.
The Committee is of the opinion that the Sangguniang Panlalawigan of Aklan is in the right direction in passing the subject resolution which embodies, among others, their earnest implore and appeal to the August Senators of the Republic of the Philippines for their utmost understanding of, and to give due consideration to, the sentiments and plight of the Aklanons, the Local Government Units of Malay, Aklan and the Province of Aklan.
The subject resolution was referred to the committee and transmitted by SP Secretary to the Chairman of the committee on November 10, 2021 for study, report, and recommendation during the 114th Regular Session of the 13th Iloilo SP.
