PRRD signs Public Service Act Amendments

 Three months before he steps down as the country’s Chief Executive, President Duterte signs the amendments to the 85-year-old Public Service Act.

The Amendments to the Public Service Act clarifies the definition of ‘public utility’, which has been traditionally left to the judgement of the Judiciary. The law now limits ‘public utility’ to distribution and transmission of electricity, petroleum and petroleum products transmission, water distribution and wastewater systems, seaports, and public utility vehicles.
The 1987 Constitution limits foreign equity ownership of public utilities to up to a maximum of 40%.
AAMBIS-OWA Party List Representative Sharon Garin said, “A step towards liberalization is to limit the industries where foreign ownership is restricted. Under the new measure, the 40% cap on foreign equity ownership is lifted from public services not classified as public utility.”


The law also recognizes that the regulatory powers of the Public Service Commission have long been delegated to various administrative agencies.
“We did not introduce any change on the way industries are currently regulated. But we also made sure we did not come up with more restrictive rules than what we already have,” said Garin, who heads the House contingent in the Bicameral Conference Committee.
Garin, who also chairs the House Committee on Economic Affairs added, “We need more foreign investments to produce more jobs if we are to recover faster from our losses during the pandemic. Government ayuda is never enough, and neither is it sustainable.“
The Amendments to the Public Service Act was ratified by both Houses of Congress on February 2, 2022.
“This caps the two-and-a-half years of hard work I and my colleagues did during this Congress. What better gift to give the next generation but better quality public services everyone can enjoy in the next few years, “ Garin enthused.
